Terms & Conditions

Please note that this translation is provided for information purposes only and that our terms and conditions are bound by German Federal Law.

All offers, deliveries and services are subject to these terms and conditions. By placing order you agree to abide exclusively by these terms and conditions. Verbal agreements which differ from the following conditions are only valid when confirmed by us in written form. Orders will be invoiced at the prices valid at the time of delivery. Prices are subject to change without notice.

Orders are delivered on account, C.O.D or after payment in advance. For overseas customers, shipment will only be made after receipt of payment. All deliveries are made at the expense and risk of the buyer. Risk transfer takes place once the goods are no longer in our possession. At the request of the buyer, deliveries can be insured against loss or damage for a small fee. The delivery date will be considered the date of shipment. Agreed delivery times will be met wherever possible.

We reserve the right to make partial deliveries in order to facilitate quick order processing. We shall not be liable for any problems caused by acts of nature, technical problems, material defects or delays caused by our suppliers.

Complaints relating to recognisable manufacturing defects or external damage to the product must be made in writing within 8 days of receipt of the goods, by hidden defects immediately upon discovery. The goods must be returned carriage paid with a detailed description of the problem and proof of purchase (copy of delivery note or invoice). Loss or damage during transport must be reported immediately to the carrier (Deutsche Post, Spedition, Bahn, etc.). Any damage must be certified by the carrier before handing over the goods. If any damage is found despite the packaging being intact, this must be reported immediately.

Retention of title

All deliveries are made subject to payment. All goods remain the property of the seller until payment has been received in full.

Privacy

Buyer and seller both independently agree that their personal details can be held in our electronic data retrieval systems.
These details are required only for the purposes of your purchase and will not be passed on to third parties.

Place of fulfilment

Place of fulfilment and delivery is Kassel, Germany. These terms and conditions are bound by the Laws of the Federal Republic of Germany, including any business with foreign customers. Should any part of these terms and conditions be or become invalid, this does not affect the validity remaining terms and conditions. The invalid part shall be replaced by a condition which best suits the commercial aims of the original conditions.

Your right to cancel the purchase under the German Civil Code (BGB)
The following right of cancellation does not apply to sealed goods (audio recordings, video recordings or software sold on any medium) if the sealed packaging has been opened or damaged.

By law, you have the right to withdraw from the purchase of an item without reason within 14 days after the date the item is delivered. The cancellation need not contain any reason and must be made in writing or by returning the goods in time to Christina Lux-York, Erfurterstr.15, 34123 Kassel, Germany. In the case of cancellation, we will refund any payments made upon receipt of the goods.

You are required to return the goods to us, if this was not done with the cancellation, at our risk. Please note that you will be responsible for the costs of returning the items to us. Please see our additional information concerning returns.

Terms of delivery
All prices are inclusive of VAT, but exclude postage and packaging. Delivery within the Federal Republic of Germany per Deutsche Post. Free delivery within Germany on goods totalling more than € 30.00.
